Finally, the government has extended the deadlines for GSTR 9 & 9C after several requests. 

The government has ultimately extended the due date for the annual return form GSTR 9 & GSTR 9C, i.e. self-certified statement forms, for the fiscal year 2020-21. The new due date to file GSTR-9C & GSTR-9C for FY 2020-21 is 28.02.2022 instead of 31.12.2021. A Notification No. 40/2021-Central Tax dated 29.12.2021 was issued in this respect.

GSTR 9 & 9C Due Date Extension Requested by Sales Tax Bar Assoc. for FY 2020-21 

The Sales Tax Bar Association requested an extension of the due dates for filing Annual Returns in Form GSTR-9 and GSTR-9C in an application to Finance Minister Nirmala Sitharaman dated December 10, 2021. 

The deadline for filing Annual Returns and Reconciliation Statements for the period 01.04.2020 to 31.03.2021 is previously set for December 31, 2021, which also happens to be the deadline for submitting the Income Tax Audit Report Balance Sheet, Profit and Loss Account, which is set for January 15, 2022. According to the Association, a considerable number of taxpayers will be unable to file yearly returns until the end of the Income Tax audit. As a result, the association requested to extend the deadlines for GSTR-9 & 9C filing by at least two months. 

Annual Return Updates from the 43rd GST Council Meeting 

  1. Finance Act 2021 introduced a new amendment to sections 35 and 44 of the CGST Act. Assesses will be allowed to self-certify the reconciliation statement instead of having it approved by chartered accountants, making compliance with FORM GSTR-9C (reconciliation statements) easier. This change in GST law is effective for the FY 2020-21 Annual Return form GSTR 9C. 
  2. For taxpayers with ATTO (Annual Aggregate Turnover) up to INR 2 Crore, the GSTR 9 annual return form will be optional for the financial year 2020-21. 
  3. Taxpayers with an ATTO of more than INR 5 crore will be required to file a GSTR 9C reconciliation statement form for the financial year 2020-21. 
  4. The government also stated that filling out these forms will be easier now that many columns and files have been made optional. 
  5. For FY 2020-21, there is no requirement to provide HSN level information of outputs or inputs, etc.
